Completed projects

We defended our client against a payment claim of nearly PLN 50 million

We won a court case against one of the leading railway carriers – concerning additional remuneration for transport services amounting to nearly PLN 50 million. In this case, our client was one of the voivodeships.
The dispute had a complex legal nature – it concerned not only contract performance but also intricate issues related to the admissibility of state aid under EU law.
The judgment obtained is a breakthrough and is the second of its kind, setting a precedent for similar cases initiated by the carrier against other voivodeships.

We recovered a loan from a disloyal counterparty – over PLN 22 million

We won a case against KOWR regarding the determination of real estate price

We successfully represented our client in a dispute with the National Support Centre for Agriculture (KOWR) over the determination of the price of real estate subject to pre-emption rights. After exercising the pre-emption right, KOWR demanded a price reduction of approximately 35%, but as a result of our litigation activities, the court dismissed the claim, recognizing the original value as market-compliant.
The case was complex – four appraisal reports were presented, with price differences reaching up to 250%. Our team proved the legitimacy of the initial price and is currently pursuing an increase in the amount due based on delayed payment.

We obtained a favorable settlement in a case involving acts of unfair competition

The dispute was with a competitor who violated trade secrets and used the client database of the company we represented to acquire a significant number of those clients.
Our support included representing the company before the court specializing in intellectual property cases, which adjudicates disputes in the area of unfair competition. After months of negotiations, we succeeded in securing a settlement favorable to our client.

We secured key claims for a general contractor in a construction dispute

We represent a client in a construction dispute concerning an investment worth over PLN 100 million. The dispute centers around the legitimacy of the investor’s withdrawal from the contract.
Our actions led to obtaining two crucial court injunctions for the client, prohibiting the investor from enforcing insurance guarantees and continuing the investment with another contractor until the court dispute is resolved.

We achieved a favorable resolution for a shareholder in a corporate dispute

In the litigation, we challenged a resolution of a technology company through which shareholders attempted to change the rules for increasing the company’s capital in a manner disloyal to our client, ultimately aiming to dilute his shares to obtain more favorable purchase terms.
During the court proceedings, we obtained an injunction suspending the enforceability of the resolution and subsequently reached a settlement that broadly regulated the shareholder’s exit process from the company.

We successfully represented clients in disputes with landlords

Our actions in both cases led to favorable settlements for our clients. A brief summary:
Case regarding reimbursement of overpaid operating fees
This concerned the improper settlement of operating costs for common areas in an office building. Thanks to analysis and mediation, a settlement was reached before the first hearing.
Case regarding unjustified termination of a warehouse lease agreement
The landlord terminated the lease agreement citing tenant fault, threatening our client with financial claims. With our support, the termination was withdrawn and a settlement was reached, including the landlord’s waiver of claims.

We won a dispute over proprietary rights to software

We conducted a court dispute for an entity from the Kaczmarski Group, which includes Krajowy Rejestr Długów BIG S.A., ending before the Supreme Court. The dispute concerned payment of license fees for the use of licensed software. During the proceedings, we demonstrated our client’s right to use the software, despite the other party challenging the license.
The dispute was fully resolved in favor of the client. In several similar proceedings, we also secured favorable court settlements for the client.

We shaped case law in proceedings against the Energy Regulatory Office (URE)

We successfully handled cases for our clients who were fined by the Energy Regulatory Office for failing to submit or submitting late reports on the import of liquid fuels into Poland (often with penalties amounting to hundreds of thousands of PLN).
As a result of our legal actions, we obtained several favorable rulings, including from the Supreme Court, in which the courts refrained from imposing penalties on our clients, agreeing with our arguments regarding the unjustified actions of the authority.
The judgments we obtained reversed the previously unfavorable case law for entrepreneurs.
